What is an Easement?

An easement is a right held by one party that allows the use land owned by another party for a specific purpose.

They are common and often essential for infrastructure and access needs.  Most commonly easements allow access for utilities like water, electricity, or sewage, or provide a right of way for neighbouring properties.

Common Examples:

  • Utility Easements: For water, gas, or electricity infrastructure such as cables or pipes that are under, or cross over, the property that are maintained by authorities
  • Drainage Easements: Allows for stormwater or sewage flow across properties
  • Right of Way: Allows a neighbour access across your property to reach theirs

Easements do not alter the ownership of the land but may limit what the owner can do on that part of their land such as blocking access to or interfering with an easement.
