The Environmental Priority Sites Certificate (EPSC) is a fully automated, Victoria-wide report that assesses a property’s proximity to sites listed on the Environment Protection Authority Victoria’s Priority Sites Register (PSR).  The PSR lists properties where a requirement to manage contamination has been formalised.

The EPSC is commonly included in Section 32 Statements/Vendor Statements, as part of the sales process to notify potential buyers whether, or not, the property is considered to be in the vicinity of any priority sites (based on the methodology used <LINK BELOW>).

Delivered within one business day via email, the ERC provides clear, structured information to support purchasing due diligence for property transactions across Victoria.

Key features of the Environmental Priority Sites Certificate

Full state-wide coverage

The EPSC is available for all Victorian properties, providing fully automated coverage across the state. No matter where the property is located, you can access consistent and reliable information relating to its vicinity to a priority site.

Accurate and comprehensive location identification*

By geolocating each priority site to precise map references and linking them to all properties on the Victorian Register of land, the EPSC ensures accurate identification of any priority site/s that overlaps with the searched property within a 250-metre radius.

Two report types (see examples).

Unaffected - meaning the the property is not listed on, and is not within 250 metres of, any site on the Priority Sites Register as at the search date.

Affected - meaning the property is listed on, or is within 250 metres of, one or more sites on the Priority Sites Register.

*Note: proximity to a designated priority site does not indicate the presence, or not, of contamination of the searched property.

 

Why would I need a Environmental Priority Sites Certificate? (Common Uses)

The EPSC is commonly used in the Section 32 Statement/Vendor Statement, which are issued under the section 32 of the Sale of Land Act 1962, and more specifically under the application of section 32D(a) which requires Section 32 Statement/Vendors Statement to include:

“(a) particulars of any notice, order, declaration, report or recommendation of a public authority or government department or approved proposal directly and currently affecting the land, being a notice, order, declaration, report, recommendation or approved proposal of which the vendor might reasonably be expected to have knowledge.”

 The Priority Sites Register is a list of sites which have been issued a notice in relation to pollution, contamination, environmental action, or cleanup under the Environment Protection Act 2017.

It is considered that properties located in the vicinity of a priority site might also be affected by these environmental issues.

The inclusion of the EPSC in the Section 32 Statement/Vendors Statement for a property being offered for sale notifies potential buyers whether, or not the property is in the vicinity of any priority sites based on the methodology used. It is a helpful resource in the due diligence process for homebuyers, investors or developers.

The EPSC is not an environmental assessment, site investigation, or audit. It is not a statutory notice or legal determination. It does not identify all environmental issues affecting the land. It must not be relied on as evidence that land is or is not contaminated, suitable for a particular use, or compliant with environmental or planning requirements. The Priority Sites Register is not an exhaustive list of contaminated sites in Victoria. Anyone proposing to enter into a property transaction should obtain independent legal, environmental, and technical advice.
